At its sole discretion, Super Center may grant a short grace period to long-term Customers in good standing before initiating lien enforcement. This decision will be made on a case-by-case basis and does not constitute a waiver of Super Center's rights. To enforce the lien, Super Center may, at the Customer's expense, retain bailiffs or agents to secure or remove the Unit—whether it is located in the assigned Space or elsewhere on the Premises. Super Center may use physical security measures, such as tire locks or other restraints, to prevent unauthorized removal of the Unit without terminating this Agreement. If the Unit is sold or otherwise disposed of under the lien process, any funds received will first be applied to the Customer's outstanding balance, including recovery costs, legal fees, and administrative charges. Any remaining balance will be returned to the Customer. The Customer agrees to release Super Center and its employees, agents, contractors, and affiliates from all liability, loss, or damages resulting from any action taken in the enforcement of this lien. 5. DEFAULT IN PAYMENT The Customer shall be considered in default automatically upon failure to pay any Rent, fees, or charges when due, without the need for further notice. If the Customer defaults in payment and Super Center secures, removes, or stores the Unit as a result, the Customer shall remain liable for all unpaid Rent and fees up to the date payment is made in full, or until the Unit is removed and stored or sold by Super Center. Additional storage fees equal to two (2) times the regular Monthly Rent will apply if the Unit is stored by Super Center. Upon default, Super Center may also restrict future payments to cash, debit, credit card, or money order, and may charge the Customer's card on file for any amounts owing. 6. USE, MAINTENANCE, AND REPAIR The Customer may only use the Space for parking and storing the Unit. Use for any other purpose is prohibited. Only Units in lawful possession of the Customer may be stored. The Customer must not: i. cause nuisance or damage; ii. store hazardous or unlawful items; iii. conduct repairs or fabrication without written approval. The Space must be returned clean. A minimum $100 cleanup fee applies for spills or debris. Super Center may use video surveillance for security and compliance. 7. RELOCATION OF UNIT Super Center may request the Customer to relocate their Unit within the yard for maintenance or operational reasons. At least 48 hours' notice will be provided when feasible. In emergencies, the Unit may be moved without prior notice. Super Center is not liable for any damage during relocation. 8. NO LANDLORD‐TENANT RELATIONSHIP / RIGHT OF ENTRY This Agreement does not create a traditional landlord-tenant relationship. Super Center is not a bailee and is not responsible for protecting the Customer's Unit. Super Center may enter the Space at any time for inspection, emergencies, or legal compliance. Entry into the Unit (RV or vehicle) is not permitted unless authorized or required under the lien enforcement provisions. 9. NON‐LIABILITY OF SUPER CENTER & INSURANCE REQUIREMENT OF CUSTOMER Super Center is not responsible for loss or damage to the Unit or any stored property. The Customer is responsible for obtaining appropriate insurance. Super Center shall not be liable for any personal injury or property damage occurring on the Premises. Force majeure events are also excluded from liability. 10. INDEMNIFICATION OF SUPER CENTER The Customer agrees to indemnify and hold harmless Super Center and any mortgage holder from claims arising out of their use of the Space, including damage or injury caused by the Customer, their invitees, or property.
